THIS SERVICE AGREEMENT IS LEGAL AND BINDING, and will be upheld by The Mastectomy Guide to the best of our ability.

PLEASE READ IN ENTIRETY PRIOR TO PURCHASING, so you know what you are signing on for.  This Service Agreement will be referenced in case of disputes.  Reading and understanding this agreement is your responsibility.  Service agreement must be agreed upon prior to charging your credit card by checking the “Service Agreement” box on the checkout page. 

 

MONIKERS:
The Mastectomy Guide is hereinafter called “MG” in this contractual agreement.

The Mastectomy Guide’s Mentorship and Training Academy for Breast, Chest and Oncology Massage is hereinafter called “MTA program” in this contractual agreement.

Mentors in the MTA program are hereinafter called “MTA providers” or “MG Mentor(s)” in this contractual agreement.

Customers enrolled in the program are hereinafter called either “Participant” or “Participants” in this contractual agreement.

 

FULFILLMENT:
The MTA program is a virtual 6-month program delivered in various formats, including but not limited to: live presentations, group coaching calls, one-on-one mentorship calls, email communication, private community and self-paced short courses.

Fulfillment for MG is completed at the end of the 6-month period of the MTA program when all promised material has been delivered, irrespective of whether the participant was able to join.  Should participants be not able to make one or more of the live training calls, group coaching calls, one-on-one mentorship calls or other aspects of the MTA program, participants can watch missed material on their own time, should it be available. 

If a participant has registered for the Early Bird pricing, coupons, and promotions, these items must be made available for participants in a timely fashion in order for fulfillment to be completed. 

Participants must pass the final exam with a mark of 70% or higher in order to graduate  from the program and receive their certificate. 

Should MG not be able to deliver an expected piece of MTA program content due to internet issues, power outages or other unforeseen circumstances, every effort will be made to make up missed material at another time within the 6-month MTA program window.  If participants are not able to attend make-up sessions, it is up to them to obtain missed material. 

 

PRACTICE BODIES:
Every participant in the program will be practicing breast and chest massage on dedicated practice people. Practice sessions are free of charge until minimum training sessions requirements have been met.  Participants must practice on a minimum of 5 different practice people, so they will get at least 5 initial practice massage sessions completed. In addition, there must be a minimum of three subsequent treatments on at least three of your practice people.

MG will offer group discussions and mentorship feedback on practice sessions to help bolster hand skills, critical thinking and preparation for professional practice. IT IS UP TO THE PARTICIPANT TO FIND THEIR OWN PRACTICE BODIES leading up to and during the MTA program.  MG will give suggestions as to where to find practice bodies, but does not take responsibility for providing practice bodies for each participant. If a participant fails to secure the required number of practice bodies and is duly unable to complete necessary practice sessions, participant may not be eligible for graduation. 

 

CERTIFICATES:
At the end of the 6 months, participants who have completed all material delivered within the MTA program and passed the final exam with a mark of 70% or higher will receive authentic MTA Program Certificate(s) in the mail.  Participants must complete the whole program in one continuous 6-month process in order to qualify for receiving the certificate.  

 

CANCELLATIONS, CREDITS AND REFUNDS:
This service agreement is legal and binding, and serves as a contract for payment to be received in the total of $5000 USD + gst, less any early-bird pricing, coupons and promotions

There are no cancellations allowed (outside the Grace Period, see below), and the entire contract must be fulfilled in order to be eligible for graduation.  

The $500 USD Commitment Deposit is non-refundable, and is in addition to tuition fees for the MTA program.  It must be paid prior to tuition payments being made. It may be waived at the discretion of MG, if full program payment is completed upfront in one lump sum, or for other promotional purposes.

If a participant requests a new payment schedule due to unforeseen circumstances, the suggested new schedule will need to be reviewed and approved by MG.  This is only available on a one-time basis for exceptional circumstances.  A $50 admin fee is required prior to the new payment schedule being implemented, and a new Service Agreement signed. 

If payments are abandoned part way through, MG reserves the right to receive all contracted payments and may activate legal recourse to obtain funds owed. However MG prefers the participant to take the honourable course of action and finish up the agreed upon contractual payments.  By signing this Service Agreement, participants agree to take the honourable course of action.

In case of Exceptional Circumstances that will not allow participants to complete the 6-month program, participants must apply for an Exception and be approved by MG before acceptance. MG reserves the right to dispute and not approve Exceptions, provided all reasonable methods of resolution are followed. All changes and partial refunds are subject to a $50 admin fee.  

Full MTA program cancellations on behalf of MTA providers due to exceptional circumstances will result in a credit to a future MTA program for the participant. Credits are valid for 1 calendar year only, after that credits are forfeit, no exceptions, with no refunds. 

No refunds due to catching Covid-19 or other sickness that does not allow participants to attend a portion of the MTA program. 

 

GRACE PERIOD:
There is a 2 week grace period within the first 14 days of registering for the MTA program that allows participants to break contract and withdraw from the program if it becomes obvious the participant and the MG Mentor(s) are not able to work together, with the caveat that every effort for resolution within the two week grace period must be met, including but not limited to: mediated conversation(s) between participant, MG Mentor(s) and neutral third party (the mediator), the cost of which is to be covered by the participant; proof of active engagement in MTA program material delivered to date; respectful communication between participant and MG Mentor(s) of struggles participant is having in MTA program prior to mediated conversation(s).  Should these and other requirements be met in entirety with all reasonable effort at constructive conflict resolution being made, and it is still deemed the right action to terminate contractual agreements between MG and the participant, then a 70% refund of the remainder of contract fees will be honoured if participant paid in full, or the participant will pay up to 30% of the remainder of their contract fees, if paid in monthly instalments. 

 

TERMINATION:
MG reserves the right to terminate any contracts for participants within the MTA program for any reason, including but not limited to: abusive, disrespectful or otherwise contrary behaviour, inappropriate language and behaviour, sexualization of breasts and breast massage or any other body part and massage therapy treatment, non-payment of contracted funds, unworkable personality clashes, consistently poor performance without attempts by participant to fix their poor performance, victimhood approaches to conflict resolution where participant consistently does not take responsibility for their own actions and instead blames MG and anyone else for their problems, “Acts of God” that do not allow MG or MG Mentor(s) to continue teaching and termination of program must occur. 

 

MTA PROGRAM FEES:

Multi-payments:
All monthly payments must be completed prior to the MTA program finish date in order for graduation to be completed.  If there are outstanding fees, the finishing certificate and graduation will be delayed until payment is complete. Participants have up to one month after the MTA program finishes to get the remainder of their fees paid in entirety.  Late fees are subject to 10% interest per month. 

 

TRANSFERRING FROM ONE MTA PROGRAM TO ANOTHER:
Transferring from one MTA program to another is allowable, if another in the same calendar year is happening and space is available. Transfer is permitted up to 30 days prior to the original MTA program date, provided that another cohort is planned. This requires a two-step process of canceling original purchase and repurchasing the new MTA program. Therefore all MTA cancellation & cohort shifts incur a $50 admin fee. If transferring to another cohort, any early-bird pricing, coupons and promotions disappear and full tuition fees apply, to be paid in one lump sum only.
